Terms of Use

MOMEON is a digital service designed to let anyone preserve a precise instant in time and associate a few words with it. This trace takes the form of a Momeon, a digital object composed mainly of a timestamped instant and, when the user wishes, a short message. MOMEON is currently offered as part of a private beta.

A Momeon may include:

• a precise date and time, recorded to the second;
• a message of up to 150 characters;
• a name or recipient mention where this feature is offered;
• a visibility level defining the access conditions for the Momeon.

MOMEON does not currently allow photos, videos, or files to be added to Momeons.

Where necessary, creating a Momeon requires a valid user account. The user is responsible for the information and content they enter.

The official time associated with a Momeon is determined by the technical systems used by MOMEON, not by the clock displayed on the user's device. MOMEON may refuse or invalidate an attempt when there are reasonable grounds to believe it results from manipulation, malfunction, or abusive use.

MOMEON may apply a uniqueness mechanism so that the same precise instant cannot be claimed more than once under the conditions defined by the service. In the case of simultaneous attempts, the system automatically determines the retained record according to the technical processing order of the requests.

Messages are limited to 150 characters. Content exceeding this limit may be refused and will not necessarily be recorded.

A Momeon may, depending on available features, be public or private. A public Momeon can be viewed by others and may appear in the public spaces of the service. A private Momeon is not intended to be shown in public spaces. MOMEON implements technical controls intended to honor this setting. However, no system connected to the Internet can guarantee absolute confidentiality.

The user is solely responsible for the content they create, publish, or share. They agree to comply with these Terms, applicable law, and the rights of third parties.

It is notably prohibited to publish:

• threats or calls for violence;
• content constituting harassment;
• content inciting hatred or discrimination;
• fraudulent content;
• illegal content;
• content intended to impersonate a third party;
• passwords, access codes, or banking data;
• confidential information the user is not entitled to disclose;
• personal data concerning a third party without appropriate basis;
• private contact details of a third party without right or authorization;
• medical or particularly sensitive information about a third party where its publication infringes their rights;
• any sexual content involving a minor;
• any content infringing intellectual property rights;
• any content intended to disrupt or compromise the security of the service.

MOMEON may review content reported or identified as likely to breach these Terms or the law. Measures may include: no action; further review; temporary visibility limitation; deletion; feature restriction; account suspension; account closure.

The user retains their rights over their original content. They grant MOMEON only the rights necessary for the technical operation of the service.

The user may request deletion of their account or their Momeons. Certain information may need to be retained where required by law or where retention is necessary for the security of the service or the exercise of rights.

MOMEON implements technical and organizational measures intended to protect data. No system connected to the Internet can be perfectly secure, so absolute security cannot be guaranteed.

Unauthorized automated creation, spam, timestamp manipulation, circumvention of security mechanisms, or repeated violations may result in account restriction or suspension.

MOMEON strives to ensure reliable operation of the service but does not guarantee permanent or uninterrupted availability.

Features, the interface, and technical terms may evolve as MOMEON develops.

MOMEON may use expressions such as "Some moments deserve forever." These expressions describe the service's purpose and do not constitute a legal guarantee of unlimited accessibility. A Momeon may become inaccessible or be deleted to comply with the law, protect a third party's rights, apply a moderation measure, or ensure the security of the service.

MOMEON cannot be held liable for damages resulting notably from non-compliant use of the service, content published by users, temporary unavailability, or an event beyond its control. No provision of these Terms excludes liability where such exclusion is prohibited by law.

Where the user acts as a consumer, the mandatory provisions of consumer law that apply to them remain fully applicable. When MOMEON offers paid services, specific terms will be presented before any order.

MOMEON may evolve these Terms. In the event of a substantial change, affected users will be informed appropriately.

These Terms are governed by French law, subject to mandatory provisions applicable to consumers. In case of difficulty, the user is invited to contact MOMEON to seek an amicable solution first.
